Data privacy regulation imposes significant restrictions on this activity, and businesses need to ensure that they are aware of the relevant legislation when transferring personal data.

The PDPO provides for the imposition of a number of requirements on data users, in particular those that control or process personal data, where that data is intended to be transferred outside Hong Kong. This includes a requirement to verify the lawful basis for the proposed transfer, and to issue a Personal Information Collection Statement where appropriate. Although resistance to this provision from the business community means that it is unlikely to be implemented soon, its presence in the PDPO indicates that the Government is paying attention to the need for increased coordination of global regulatory standards in this area.
